Agreement to these Terms

These Terms of Service (“Terms”) are a binding agreement between you and Exposed Vocals, LLC (“Exposed Vocals,” “EV,” “we,” “us” or “our”). They govern your access to and use of exposedvocals.com and the accounts, profiles, feeds, editorial features, communications, purchases, subscriptions and other services EV makes available through the website or identifies as subject to these Terms (collectively, the “Platform”).

By accessing or using the Platform, creating an account, submitting content, casting a vote, or purchasing a product or subscription, you agree to these Terms and acknowledge EV’s Privacy Policy. Additional terms presented for a particular product, campaign, promotion, opportunity or feature also apply. If those additional terms conflict with these Terms, the more specific terms control for that product or feature.

If you do not agree, do not use the Platform.

If you use EV for an artist, band, label, agency, publication, company or other organization, you represent that you have authority to accept these Terms for that person or organization. In that case, “you” includes both you and the represented party.

Eligibility and use by minors

You must be legally able to enter this agreement.

You must be at least 18 years old, or the age of legal majority where you live, to create an account or purchase EV services on your own. A person who is at least 13 but under the age of legal majority may use EV only with the consent and supervision of a parent or legal guardian who agrees to these Terms and is responsible for the minor’s activity and purchases. The Platform is not directed to children under 13, and they may not create an account or submit personal information to EV.

If you use EV on behalf of an organization, you must have authority to bind that organization. You may not use the Platform if doing so is prohibited by applicable law or if EV previously suspended you and has not authorized your return.

Accounts and account security

Provide accurate, current and complete information when creating or maintaining an account. Keep your email address current so EV can send account, security, order and legal notices.

You are responsible for:

• Protecting your password and authentication methods.
• Activity performed through your account, except to the extent caused by EV’s own failure to use reasonable safeguards.
• Making sure anyone who manages the account has appropriate authority.
• Notifying EV promptly if you suspect unauthorized access, impersonation or account compromise.

Do not share passwords, verification codes, payment credentials, private keys or other sensitive access information with anyone claiming to be EV. EV support does not need your password.

EV may require email confirmation, identity information or other reasonable proof before restoring access, changing account ownership, approving a claimed profile or addressing a security-sensitive request.

One person or organization may manage more than one legitimate artist or professional identity when authorized to do so. Creating deceptive duplicate accounts, impersonating another person, evading enforcement or manufacturing engagement is prohibited.

What EV provides

EV is an independent music publication and professional music platform. Depending on availability and development stage, the Platform may include:

• Artist, professional and organization profiles.
• A Professional Footprint showing profile progress and next steps.
• Music, video, release, credit, biography and career information.
• The Signal activity feed, posts, replies, follows and professional connections.
• Editorial articles, interviews, reviews, premieres and promotional services.
• Embedded audio and video hosted by third-party platforms.
• Charts, voting, discovery and community features.
• EV Verified identity or account-status indicators.
• Purchases, subscriptions, campaigns and agency tools.
• Professional search, recommendations, opportunity routing and matching.

Features may be introduced, tested, changed, limited, paused or retired. Some features may be free; others may require a purchase, subscription, eligibility status or separate agreement.

EV is not a record label, talent agent, manager, employer, union, law firm, royalty administrator, rights-clearance service, streaming service or distributor unless a separate written agreement expressly says otherwise. EV does not become a party to a deal between users merely because the connection began on the Platform.

Profiles, identity and Professional Footprint

Profiles are designed to present an artist’s or professional’s work, identity, credits, activity and goals. You are responsible for keeping your profile accurate and for having permission to publish the information, images, logos, credits and links it contains.

EV may allow authorized people to claim or manage existing profiles. A profile claim, role label or EV Verified status may require evidence and may be denied, revoked or re-reviewed when information is incomplete, disputed or misleading.

EV Verified means only what the Platform states at the time—for example, that EV reviewed specified identity or account information. It is not an endorsement of talent, character, professional conduct, financial condition, rights ownership or future success. Verification is not for sale and does not improve chart position or matching rank.

Professional Footprint percentages and completion labels are progress tools. They are not ratings, credit scores, guarantees of quality, measures of artistic worth or promises of opportunity. EV may recommend both free and paid actions that help complete a profile or document professional activity. Buying a service does not purchase status, praise, ranking preference or a guaranteed connection.

Content you submit

“User Content” means material you submit, upload, publish, transmit or otherwise provide through the Platform. It may include profile information, biographies, photos, artwork, posts, replies, comments, links, embedded media, music and release metadata, credits, opportunity responses, messages and other materials.

You retain ownership of User Content you own. These Terms do not transfer ownership of your underlying music, sound recordings, compositions, videos, photographs, trademarks or other original work to EV.

You represent and warrant that:

• You own the User Content or have every permission, license and authority needed to submit it and authorize EV’s use under these Terms.
• The User Content and EV’s permitted use of it do not violate copyright, trademark, publicity, privacy, contract or other rights.
• Credits, ownership claims, professional roles, locations, release information and other factual statements you provide are accurate and not misleading.
• You have obtained any required consent from people identified, pictured, quoted or credited in the User Content.
• Your submission complies with these Terms and applicable law.

Submitting a link or embed does not transfer ownership of the underlying file. Different rights may exist in a musical composition, sound recording, video, photograph, artwork, performance, lyrics and brand identity. You are responsible for all rights necessary for the material you submit.

License you give EV

To operate, display, secure and promote the Platform, you grant EV a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, adapt for technical display, publish, display, distribute and make your User Content available through the Platform. This license also allows EV to use the submitted artist, professional or organization name, approved images, logos and excerpts to identify and promote the content, profile, feature or Platform.

EV may permit its service providers to exercise this license only as needed to operate, secure, analyze, distribute or promote the Platform. EV may also technically resize, crop, transcode, excerpt or reformat content so it works across devices, feeds, emails, previews, search results and social promotions. EV will not claim ownership of your underlying User Content merely because of these technical uses.

This license continues while your User Content remains on the Platform. If content is removed, the license ends within a commercially reasonable period except to the extent:

• The content remains in backups, security records or legal archives.
• EV must retain it to comply with law, resolve a dispute or enforce these Terms.
• Other users shared or interacted with a copy through a feature that reasonably preserves the conversation.
• It forms part of a completed editorial work, purchased deliverable, campaign record or historical publication that EV is entitled to keep under these Terms or another agreement.
• EV already used it in distributed promotional material that cannot reasonably be recalled.

If EV produces an article, review, interview, graphic, campaign asset, page design or other editorial or creative deliverable, the underlying materials you supplied remain yours or their owner’s. EV owns its original editorial writing, design, compilation, formatting and production work unless the product terms or a written agreement say otherwise.

Acceptable use and community standards

Use EV to participate in music and professional activity honestly and safely. You may not use the Platform to:

• Break the law, encourage illegal conduct or violate another person’s rights.
• Infringe copyright, trademark, publicity, privacy or other intellectual-property rights.
• Harass, threaten, stalk, exploit, defame or target people with hateful or abusive conduct.
• Publish sexual exploitation material, content that endangers minors, or intimate material without consent.
• Impersonate another person or organization, fabricate professional credentials, or falsely claim authority over an artist, profile, catalog or company.
• Scam users; request deceptive payments; promote fraudulent opportunities; or misrepresent a job, deal, audition, service or investment.
• Publish private or sensitive information without authorization, including home addresses, financial credentials, passwords or authentication codes.
• Send spam, mass solicitations, chain messages or irrelevant promotions.
• Manipulate votes, charts, follows, views, engagement, verification, reviews, recommendations or matching through bots, purchased activity, coordinated fraud or deceptive accounts.
• Upload malware, probe security, disrupt the Platform, bypass access controls or help others do so.
• Scrape, crawl, harvest or systematically extract Platform data without EV’s written permission, except as allowed by applicable law.
• Reverse engineer or misuse Platform software except where applicable law expressly permits it.
• Use EV content, member data or communications to build unauthorized databases, train models, profile people or make automated decisions about them.
• Misrepresent materially altered, synthetic or AI-generated content in a way likely to deceive people about identity, authorship, performance or source.
• Evade a suspension, removal, block, rate limit or other enforcement action.

EV may publish more detailed Community Rules or feature-specific standards. Those rules form part of these Terms once posted or presented in the relevant feature.

The Signal, follows, connections and communications

The Signal and related social features let members publish activity, respond, follow profiles and build professional connections. Material posted to public areas should be treated as public. It may be viewed, shared or indexed outside EV even if you later remove it.

A follow, connection, reply, recommendation or message does not establish employment, representation, partnership, confidentiality or a professional duty. Do not send confidential music, contracts, unreleased business information or sensitive personal data unless you independently trust the recipient and have appropriate terms in place.

You control whether to respond to another user. EV does not guarantee a response, introduction, meeting, deal or safe outcome. Evaluate identities, opportunities and contract terms independently before sharing files, traveling, paying money or entering an agreement.

EV may use automated systems, member reports and human review to identify abuse or policy violations. Unless required by law, EV has no obligation to pre-screen every post or communication.

Music, video and third-party embeds

EV commonly displays players, videos or links supplied by third-party services such as YouTube and other supported platforms. The underlying media may remain hosted and controlled by that third party, not EV.

When you submit an embed or link, you authorize EV to display it with the related title, artist, artwork, metadata and page information you provide. You must comply with the host platform’s terms and have the rights needed to publish the material and associated assets.

Third-party availability can change. A host may restrict, monetize, remove, geoblock or stop serving content without EV’s control. EV may disable a page or embed, but it may be unable to remove the original file from the host platform.

Free or immediate publishing does not mean content is exempt from these Terms. Content may go live before human review and may later be corrected, restricted or removed.

Editorial coverage and independence

EV publishes independent editorial work and may also sell clearly described editorial, promotional or production services. These are not the same thing.

Unpaid pitches are considered at EV’s discretion. Sending a pitch does not guarantee a reply, acceptance, publication date, format, placement or coverage.

For a paid service, payment buys only the work and deliverables described on the product page or order confirmation. Payment never buys:

• Guaranteed praise or a predetermined opinion.
• EV Verified status.
• Chart movement or votes.
• Preferential matching or discovery rank.
• Guaranteed streams, followers, press pickup, playlist placement, label interest, employment, investment or commercial success.

Reviews and editorial assessments may contain honest opinions, including criticism. EV may decline or cancel work that lacks required materials, raises rights or authenticity concerns, conflicts with editorial standards, or cannot lawfully or responsibly be completed. Any refund in that situation is governed by the product terms, order status and the Cancellations and refunds section below.

EV may correct factual errors, update disclosures, edit for clarity and style, or label sponsored and paid work where appropriate. Editorial decisions about headlines, excerpts, layout, categorization, moderation and presentation remain with EV unless a written agreement expressly says otherwise.

Agency Press Desk and submissions for others

Agency Press Desk and similar professional tools may allow publicists, labels, managers or other representatives to maintain rosters, organize materials, submit campaigns or request services for clients.

If you use these tools, you represent that:

• You are authorized to act for every client or artist you submit.
• You have permission to provide their information and materials to EV.
• Your roster, roles, credits, campaign claims and contact information are accurate.
• You will promptly remove or update clients you no longer represent.
• You will not imply that an EV subscription guarantees coverage or approval.

The account holder is responsible for authorized users, client permissions and activity under the account. EV may request evidence of authority and may pause disputed work while ownership or representation is reviewed.

Charts, voting and community signals

EV may operate charts, voting, rankings, badges or other community signals. Each feature may have its own published rules, eligibility window and calculation method.

Unless a feature expressly says otherwise:

• Votes are community participation signals, not purchases, investments or promises of career advancement.
• Payment to EV does not buy votes, rank or chart movement.
• EV Verified status does not improve chart position.
• Chart activity does not affect professional matching priority.
• EV may exclude fraudulent, automated, duplicate, incentivized or otherwise invalid activity.
• EV may correct errors, recalculate results, resolve ties, pause voting or remove ineligible entries to protect integrity.

Attempting to manipulate a chart or vote may result in disqualification, removal of activity, account restrictions or termination. EV does not guarantee that charts will remain available or that any result will lead to coverage, opportunity or commercial success.

Recommendations, matching and opportunities

EV may introduce discovery, recommendation, search, matching and opportunity features intended to help artists and music professionals find relevant people, music or needs. These tools may use information such as roles, skills, genre, location, goals, availability, professional readiness, rights information, activity and stated preferences.

Matching is decision support, not a verdict. A recommendation means only that available data suggests possible relevance under the feature’s current criteria. It does not guarantee compatibility, quality, identity, rights ownership, safety, response, selection, employment, representation, funding, placement or a completed deal.

EV’s matching principles are:

• No pay-to-rank. A purchase does not secretly improve professional matching priority.
• No public compatibility percentage, star score or swipe-style judgment of professional worth.
• Verification may establish identity or account status but does not improve match rank.
• Chart votes and popularity do not control professional matching.
• Users and opportunity owners retain the final decision.

EV may change recommendation criteria, test different signals or withhold details that would enable manipulation. You must not submit false attributes, spam opportunity owners or use recommendations to discriminate unlawfully. Unless EV expressly identifies itself as the contracting party, EV is not a recruiter, employer, representative or party to an opportunity or resulting agreement.

Purchases and order terms

Prices, currencies, taxes, billing schedules and included deliverables are shown at checkout or in the applicable product description. Review them before placing an order. The product description and order confirmation are part of your agreement with EV.

By placing an order, you:

• Authorize EV and its payment processors to charge the payment method for the displayed amount.
• Represent that you are authorized to use the payment method.
• Agree to provide complete and usable materials by any stated deadline.
• Understand that missing, inaccurate or late materials may delay production.
• Accept any product-specific limits, revision terms, eligibility rules and fulfillment conditions shown before purchase.

EV may use third-party payment processors. EV generally does not receive or store the complete card number entered into a processor’s secure checkout. Your use of a payment provider may also be governed by that provider’s terms.

EV may correct obvious pricing or description errors before fulfillment. If EV cannot fulfill an order because of such an error, it will notify you and provide the remedy required by applicable law, which may include cancellation and refund of the affected charge.

Do not submit a knowingly false chargeback or payment dispute. Nothing in these Terms prevents you from using lawful dispute rights. Contacting EV first may allow a billing or fulfillment problem to be resolved faster.

Subscriptions and automatic renewal

Some EV services renew automatically. Before purchase, checkout should disclose the price, billing frequency, renewal terms and how to cancel.

By starting an automatically renewing subscription, you give EV and its payment processor express permission to charge the disclosed subscription price, plus applicable taxes, to your selected payment method at each billing interval until you cancel or the subscription ends.

You may cancel future renewals through the subscription controls in your account or payment service when available. If the control is unavailable or does not work, contact admin@exposedvocals.com with the account email and subscription or order number. EV will provide a simple cancellation method as required by applicable law.

Cancellation stops future renewals. Unless the product terms or applicable law say otherwise, it does not retroactively refund the current billing period, reverse completed work or cancel production already underway. Access and benefits may continue through the end of the paid period, subject to these Terms and the product’s stated rules.

If EV changes a subscription price or a material renewal term, EV will provide any notice and obtain any consent required by applicable law before the change applies. Failed payment may result in retries, a grace period, suspension or cancellation. You remain responsible for charges validly incurred before cancellation.

Promotions, discounts and credits

Coupons, promotional prices, trials, account credits and limited offers may have separate eligibility, expiration and use rules. Unless the offer says otherwise, they have no cash value, cannot be transferred or resold, and cannot be combined. EV may refuse or reverse use involving fraud, duplication, technical error or violation of the offer rules.

A free trial that converts to a paid subscription must disclose the conversion timing and price before enrollment. Cancel before the disclosed deadline to avoid the next charge.

Delivery, revisions and customer materials

Editorial and professional services depend on timely, accurate materials. A delivery estimate begins only when EV has received the payment and all required links, images, credits, permissions, answers, approvals and other inputs.

Unless a product states otherwise:

• Timing is an estimate, not a guaranteed publication date.
• Revisions correct factual errors or bring the work within the purchased scope; they do not automatically include a new concept or unlimited rewrites.
• Delays caused by missing materials, rights questions, platform outages or events outside EV’s reasonable control extend the schedule.
• You are responsible for reviewing names, credits, links and factual details you supply.

EV may close or archive an inactive order after reasonable attempts to obtain required materials. Before doing so, EV should provide notice through the account email when practical. Any credit, restart or refund is governed by the product terms and applicable law.

Cancellations and refunds

Refund eligibility depends on the product, whether work has begun, whether deliverables have been created or published, and the terms displayed at purchase.

Unless applicable law or the product terms require otherwise:

• Request cancellation as soon as possible and include the order number.
• An order may be eligible for cancellation and refund when EV has not begun production and has not incurred product-specific costs.
• Once research, writing, editing, design, campaign setup, placement, outreach or other production has begun, some or all of the purchase may be nonrefundable.
• Completed, delivered or published work is not refundable merely because it did not produce a hoped-for audience, response, opportunity or business result.
• Subscription cancellation stops future renewal and does not automatically refund the current term.
• Duplicate or unauthorized charges will be reviewed and corrected when supported by the account and payment records.

Send billing and refund requests to admin@exposedvocals.com. EV will review the specific order rather than promise that every active or completed service can be refunded. Nothing in this section limits non-waivable rights under applicable consumer law.

Intellectual property belonging to EV

The Platform and its original software, design, layout, databases, taxonomies, logos, brand elements, editorial writing, graphics and other EV-created material are owned by EV or its licensors and protected by applicable law.

Except for the limited right to use the Platform under these Terms, EV grants no ownership or license in its intellectual property. You may not copy, sell, license, republish, frame, mirror, remove rights notices from, or create derivative commercial products from EV material without written permission, except where applicable law permits.

“Exposed Vocals,” “EV,” related logos and Platform feature names may be trademarks or service marks of EV. Do not use them to imply sponsorship, endorsement or affiliation without permission.

You may share ordinary links to public EV pages and use available sharing tools, provided you do not misrepresent the page or your relationship with EV.

Copyright complaints

EV respects copyright and expects users to do the same. Copyright owners and authorized agents should use EV’s DMCA and Copyright Policy to submit a notice. Users whose material was removed following a DMCA notice may use the counter-notification process described there.

EV may terminate, in appropriate circumstances, accounts of users it determines are repeat infringers. EV may also remove or restrict content when it reasonably believes action is needed to protect rights, even if a notice does not qualify for a statutory process.

The DMCA process is for copyright claims—not criticism, billing issues, trademark disputes, defamation, privacy concerns or general complaints.

Privacy and public information

EV’s Privacy Policy explains how EV collects, uses and shares personal information. Review it before using the Platform.

Profiles, posts, replies, credits, embedded media and other information submitted to public areas may be visible worldwide, shared by others and indexed by search engines. Do not publish a home address, private phone number, financial credential, password, authentication code or other information you do not want public.

Privacy settings reduce visibility only to the extent described by the feature. They cannot guarantee that another person will not copy, screenshot or disclose information they were permitted to view.

If you submit information about another person, you must have authority to do so. Professional and opportunity features must not be used to collect sensitive information or make unlawful discriminatory decisions.

Third-party services and links

The Platform may connect to or display services operated by others, including video and audio hosts, social networks, analytics services, sign-in providers, payment processors and external websites.

EV does not control those services and is not responsible for their availability, security, content, policies or independent actions. Your use of a third-party service is governed by its own terms and privacy policy. A link, embed or integration does not mean EV endorses every item, claim or transaction on that service.

You are responsible for reviewing external offers and protecting your accounts. EV is not liable for a third party’s removal of content, account restriction, policy change, outage or use of data, except to the extent applicable law provides otherwise.

Moderation, enforcement and appeals

EV may investigate suspected violations using content, account records, technical signals, member reports and other reasonably available information. EV may take proportionate action, including:

• Adding a warning or correcting metadata.
• Limiting reach, interaction or access to a feature.
• Removing or disabling content, links or embeds.
• Invalidating votes, engagement or chart activity.
• Pausing an order, opportunity, profile claim or verification review.
• Suspending or terminating an account.
• Preserving records or reporting conduct where legally required or reasonably necessary to protect people and the Platform.

EV may act without advance notice when it reasonably believes delay could create harm, legal exposure, security risk, fraud or evidence loss. Otherwise, EV may provide notice and an opportunity to correct or appeal when practical.

To appeal an account or content decision, contact admin@exposedvocals.com from the account email and include the relevant URL, account name and concise reason you believe the decision should be reconsidered. EV may decline repetitive, abusive or unsupported appeals.

EV does not promise to monitor all content or resolve every dispute between users. Failure to enforce a rule in one situation does not waive EV’s right to enforce it later.

Suspension, termination and account closure

You may stop using EV at any time. Available account-closure and data-request rights are described in the Privacy Policy and account tools.

EV may suspend or terminate access when you materially or repeatedly violate these Terms, create risk or legal exposure, fail to pay valid charges, misuse the Platform, or when continued service is no longer commercially or technically feasible. Where appropriate, EV may provide notice and time to address the issue.

Termination does not erase obligations or rights that by their nature should continue, including payment obligations, ownership provisions, completed publication rights, legal record retention, disclaimers, limitations of liability, indemnification and dispute provisions.

Closing an account does not automatically remove public editorial coverage, completed deliverables, lawful historical records, third-party copies or material EV must retain. EV will handle personal information according to the Privacy Policy and applicable law.

Disclaimers and no guaranteed results

To the fullest extent permitted by law, the Platform and all content, recommendations and services are provided “as is” and “as available.” EV disclaims implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty arising from course of dealing or usage of trade.

EV does not warrant that the Platform will be uninterrupted, error-free, secure or free of harmful components; that all information supplied by users is accurate; or that defects will always be corrected.

EV does not guarantee:

• Publication, placement, traffic, streams, followers, votes or chart position.
• Positive reviews, press pickup, playlist placement or audience response.
• Verification, profile completion or search visibility.
• A match, reply, introduction, meeting, job, deal, representation, funding or licensing outcome.
• The identity, authority, conduct, solvency, rights ownership or suitability of another user.
• Revenue, career advancement or any specific commercial result.

You remain responsible for creative, professional, financial and legal decisions. Verify people, rights, opportunities and contract terms independently, and obtain professional advice where appropriate.

Some jurisdictions do not permit certain warranty exclusions, so some exclusions may not apply to you.

Limitation of liability

To the fullest extent permitted by law, EV and its owners, officers, employees, contractors, affiliates and service providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data, goodwill, opportunity or business interruption, arising from or related to the Platform or these Terms, even if advised that such damages were possible.

To the fullest extent permitted by law, EV’s total aggregate liability for all claims arising from or related to the Platform or these Terms will not exceed the greater of (a) the amount you paid directly to EV during the 12 months before the event giving rise to the claim, or (b) US $100.

These limitations apply regardless of the legal theory and to the extent permitted by law. They do not exclude liability that cannot legally be excluded, which may include liability for intentional misconduct, fraud, gross negligence, personal injury caused by negligence, or violation of non-waivable consumer rights, depending on applicable law.

Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify and hold harmless EV and its owners, officers, employees, contractors, affiliates and service providers from claims, losses, liabilities, damages, judgments, costs and reasonable attorneys’ fees arising from or related to:

• Your User Content.
• Your use or misuse of the Platform.
• Your violation of these Terms or applicable law.
• Your infringement or violation of another person’s rights.
• Your representation of an artist, client or organization without authority.
• A transaction, opportunity, contract or dispute between you and another user.

EV may control the defense of a covered claim and require your reasonable cooperation. You may not settle a claim in a way that admits wrongdoing by, imposes obligations on, or restricts EV without EV’s written consent.

This section does not require a consumer to indemnify EV for EV’s own unlawful conduct where applicable law prohibits it.

Governing law and disputes

These Terms and any dispute arising from or related to them or the Platform are governed by the laws of the United States, without regard to conflict-of-law principles, except to the extent non-waivable law in your place of residence applies. Disputes will be handled in U.S. federal courts, except to the extent applicable law allows or requires another forum.

Before filing a lawsuit, you and EV agree to make a good-faith effort to resolve the dispute informally. Send a written notice describing the issue, requested resolution and relevant account or order information to the contact in the Contact Exposed Vocals section below. The parties will have 30 days after receipt to attempt resolution, unless immediate relief is reasonably necessary.

Nothing in this section prevents either party from seeking temporary or injunctive relief to protect security, intellectual property or confidential information, or from bringing an eligible matter in small-claims court.

Changes to the Platform or these Terms

EV may update the Platform and these Terms as products, technology, law and business practices change.

When a change is material, EV will provide reasonable notice through the Platform, account email or another appropriate method before the change takes effect, unless a faster change is required for law, security or abuse prevention. The updated page will show its effective date.

Your continued use after updated Terms take effect means you accept them. If you do not agree, stop using the Platform and cancel any subscription before its next renewal. Changes do not retroactively alter a completed order unless the order terms or applicable law allow it.

Feedback

If you send EV ideas, suggestions or feedback about the Platform, you grant EV a worldwide, perpetual, irrevocable, non-exclusive, royalty-free right to use, adapt and commercialize that feedback without restriction or compensation. This does not give EV ownership of unrelated music, creative work or confidential material merely because you contacted us.

Do not submit confidential ideas unless EV has agreed in writing to receive them confidentially.

Electronic communications

You agree that EV may send account, order, security, transactional and legal notices electronically, including by email, account notification or posting on the Platform. Keep your account email current.

Marketing messages are separate from essential service communications. Where required, EV will obtain consent and provide a way to unsubscribe from marketing. Unsubscribing from marketing does not stop necessary account, order, security or legal messages.

General terms

These Terms, the Privacy Policy, applicable product terms and any feature-specific rules form the entire agreement between you and EV regarding the Platform, unless a separate signed agreement applies.

If a court finds part of these Terms unenforceable, the remaining provisions remain in effect and the affected provision will be enforced to the maximum lawful extent. EV’s failure to enforce a provision is not a waiver. Headings are for convenience and do not limit the text.

You may not assign these Terms or transfer your account without EV’s written consent. EV may assign these Terms as part of a merger, acquisition, financing, reorganization, sale of assets or by operation of law, subject to applicable legal requirements.

EV is not responsible for delay or failure caused by events beyond its reasonable control, including natural disasters, war, civil unrest, labor disputes, internet or hosting failures, platform-provider outages, government action or widespread security incidents.

No agency, partnership, joint venture, employment or fiduciary relationship is created by these Terms.
